Legal
Terms of Service
Last updated: 25 October 2026
This English version is provided for convenience. The Italian version ("Termini e condizioni") is the legally binding text.
These terms apply to every sale of products and every service provided by IMECA3D through www.imeca3d.com, by email, by WhatsApp or in any other way. A written quotation or an agreement signed by both parties takes priority over these terms where the two differ.
- Part A applies to all customers and all orders.
- Part B applies to products bought in the online shop.
- Part C applies to custom work: 3D printing of customer files, design, engineering and prototyping services.
Part A – General terms
A1. Who we are
IMECA3D is the trade name of Madavita Vithanage Chamindu Jayathra Perera, sole trader, Via Roma 343/3, 30038 Spinea (VE), Italy, VAT number (P.IVA) 04814140275, email imeca3d@gmail.com, phone/WhatsApp +39 331 464 9822 (English) or +39 349 093 8896 (Italian).
A2. Customers
We work with:
-
consumers: private individuals buying for purposes outside any business or profession. Consumers have the additional rights given by the Italian Consumer Code (Legislative Decree 206/2005), which these terms never limit;
-
business customers: companies, professionals and freelancers buying for their business;
-
universities and public bodies.
Students buying for personal study projects are consumers. Universities and research groups ordering through their institution are public or business customers.
A3. Quotations
Quotations are free and valid for 30 days unless they state otherwise. A quotation describes the scope of the work, the deliverables, the price, the payment terms and the expected delivery time. An order is confirmed when you accept the quotation in writing (email is enough) and, where required, pay the amount due at that stage.
A4. Prices
IMECA3D operates under the Italian flat-rate tax scheme ("regime forfettario", Law 190/2014, art. 1, paragraphs 54–89). No VAT is added to our prices: the price shown or quoted is the final price, for consumers, businesses and public bodies alike. For the same reason, our invoices are not subject to withholding tax (ritenuta d'acconto).
Invoices above €77.47 carry a €2 stamp duty (imposta di bollo), which is added to the invoice. Shipping costs are shown separately before you confirm an order.
A5. Payment
| Order type | When payment is due |
|---|---|
| Shop products | 100% at checkout |
| Custom 3D printing | 100% when the quotation is accepted |
| Design and engineering work up to €300 | 100% when the quotation is accepted |
| Design and engineering work above €300 | 50% deposit to start, 50% on completion |
| Projects above €1,500 | In stages, as set out in the quotation (for example 30% at start, 40% at design approval, 30% at delivery) |
| Universities and public bodies | As agreed in the quotation, by electronic invoice |
Payment methods: bank transfer, or card and other methods offered through Stripe (for example Klarna) where available. IMECA3D never sees or stores your full card details.
Parts are shipped and final files are released only after full payment, unless the quotation states otherwise.
For business customers and public bodies, late payment automatically incurs statutory interest and the flat compensation for recovery costs under Legislative Decree 231/2002.
A6. Delivery times
Delivery times are estimates given in good faith and start from order confirmation and receipt of payment and of all information needed. For consumers, unless a different date is agreed, goods are delivered within 30 days of the order (art. 61 Consumer Code). If a delay occurs, we will tell you promptly. Consumers may then set a further reasonable deadline and, if it is not met, cancel the order and receive a full refund.
A7. Intellectual property
-
Your files stay yours. You keep all rights in the files, drawings and information you send us. We use them only to quote and carry out your order.
-
Designs we create for you (CAD models, drawings and other project deliverables, including work by our freelance collaborators) pass to you once the project has been paid in full. Until then, IMECA3D keeps all rights in them.
-
IMECA3D keeps its general know-how, methods, templates and standard components, which it may reuse in other projects without revealing your confidential information.
-
We show a project in our portfolio or on social media only with your written permission.
-
The shop's product designs, photos and texts remain the property of IMECA3D.
A8. Files you send us
By sending us a file you confirm that you have the right to use it and to have it manufactured, and that it does not infringe anyone else's rights (for example patents, designs, trademarks or copyright). If a third party makes a claim because of a file you supplied, you are responsible for it.
We may decline any order. We do not manufacture weapons or parts of weapons, counterfeit or infringing products, or items intended for illegal use.
A9. Confidentiality
We treat all files and project information you send us as confidential, even without a signed non-disclosure agreement (NDA). We share them only with the providers listed in the Privacy Policy and, where a project needs it, with freelance collaborators bound by written confidentiality and data protection obligations, always only as far as needed for your order. Your NDA, if any, applies to them too. You can ask us to keep your project within IMECA3D only. We are happy to sign your NDA, or to provide ours, before you share sensitive information.
A10. Retention of files
Quote requests and files that do not lead to an order are deleted after 12 months. Project files for completed orders are kept for 24 months so that repeat orders and reprints are possible, and are deleted earlier if you ask. Files covered by an NDA are handled as the NDA states. See the Privacy Policy.
A11. Limitation of liability
IMECA3D's total liability for any order is limited to the price paid for that order. This limit does not apply to damage caused by wilful misconduct or gross negligence (art. 1229 Civil Code), to death or personal injury, or to any right that consumers have under the Consumer Code, including product liability. IMECA3D is not liable for indirect losses such as lost profit, production downtime or lost data, except where the law does not allow this exclusion.
A12. Force majeure
Neither party is liable for delays or failures caused by events outside its reasonable control, such as natural disasters, power or internet outages, strikes, carrier failures or supplier shortages. We will tell you promptly and agree a new timeline or, if that is not possible, refund any amount paid for work not carried out.
A13. Governing law and disputes
These terms are governed by Italian law. For business customers and public bodies, the Court of Venice has exclusive jurisdiction. For consumers, the court of the place where the consumer lives has jurisdiction (art. 66-bis Consumer Code). Consumers living in another EU country also keep the protection of the mandatory rules of their own country.
Before going to court, please contact us: most problems can be solved by email.
A14. Other provisions
If any clause is found invalid, the rest of these terms remains in force. We may update these terms. The version in force on the date of your order applies to that order.
Part B – Online shop
B1. Products
Shop products are standard items designed and made by IMECA3D. Photos are representative. Because parts are 3D printed, small variations in colour, surface texture and visible layer lines are normal and are not defects. The product page states the material, the main dimensions and what the product is designed for.
B2. How a purchase works
You choose the products, enter your details and pay through Stripe Checkout. The contract is formed when you receive our order confirmation email. If a product cannot be supplied, we will tell you and refund you in full.
Business customers can enter their company name and VAT number at checkout to receive a business invoice.
B3. Shipping
Shipping options, costs and estimated delivery times are shown at checkout. For consumers, risk of loss or damage passes when you, or someone you name, receive the goods. For business customers, risk passes when the goods are handed to the carrier. Please check the package on delivery and note any visible damage with the courier.
B4. Right of withdrawal (consumers only)
If you are a consumer, you can withdraw from your purchase within 14 days of receiving the goods, without giving a reason.
-
How: send us a clear statement by email to imeca3d@gmail.com. You may use the model form below, but you do not have to.
-
Return: send the goods back within 14 days of telling us. You pay the direct cost of returning them.
-
Refund: we refund all payments received, including standard delivery costs, within 14 days of receiving your withdrawal. We use the same payment method you used. We may wait until we receive the goods, or proof that you sent them, before refunding.
-
Condition: you may handle the product as you would in a shop to check it. If it has been used beyond that, we may deduct an amount for the loss in value.
The right of withdrawal does not apply to products made to your specifications or clearly personalised, for example a shop product ordered with custom dimensions, text or other changes you asked for (art. 59(1)(c) Consumer Code). This right applies only to consumers, not to business customers.
Model withdrawal form – download the fillable PDF (fill it in on screen or print it), or copy the text below into an email.

I hereby give notice that I withdraw from my contract for the sale of the following goods: ________
Ordered on: ________ – Received on: ________
Name: ________
Address: ________
Date: ________ – Signature (only if sent on paper): ________
B5. Legal guarantee of conformity
Consumers are entitled to the legal guarantee of conformity for 2 years from delivery (articles 128 and following, Consumer Code). If a product is faulty or not as described, contact us within 2 months of discovering the problem. We will repair or replace it, or, where that is not possible, reduce the price or refund you.
For business customers, the Civil Code applies: defects must be reported within 8 days of discovery, and claims expire one year after delivery (art. 1495 Civil Code).
The guarantee does not cover damage from misuse, use outside the stated purpose or conditions (for example temperatures above the material's limits), modification, or normal wear.
Part C – Custom work
C1. Custom 3D printing of your files
-
Your design, your responsibility. When you supply the file, you are responsible for the design and for whether the part is suitable for its purpose. We check that the file can be printed and tell you about any obvious problems we notice, but we do not check whether your design will work in its application unless that check is part of the quotation.
-
Tolerances. 3D printed parts have dimensional tolerances and surface characteristics that depend on the process, material and geometry. Unless the quotation states specific tolerances, the normal accuracy of the process applies. Visible layer lines and small marks from supports are normal and are not defects.
-
Critical applications. Unless agreed in writing, printed parts are not intended for safety-critical, medical, food-contact or load-bearing uses where failure could cause injury.
-
No withdrawal right. Parts printed from your files are made to your specifications, so the consumer right of withdrawal does not apply (art. 59(1)(c) Consumer Code). If a part does not match the agreed file and specifications, we will reprint it or refund you.
C2. Design, engineering and prototyping services
-
Scope. The quotation defines the work, the deliverables (for example STEP files, native CAD files, 2D drawings, prototypes) and the number of revision rounds. Unless it states otherwise, two rounds of revisions are included. Further changes, or changes to the agreed requirements, are quoted separately before any work is done.
-
Approval. We send previews (for example screenshots, PDF drawings or 3D viewer links) for your approval. Final editable files are released once the project has been paid in full.
-
Your information. The result depends on the requirements, dimensions and samples you provide. We are not responsible for errors caused by incorrect or incomplete information supplied to us.
-
Your responsibility for production and certification. You are responsible for testing, validating and, where required, certifying the final product before production or sale (for example CE marking), unless that work is included in the quotation.
-
Cancellation by the customer. You may stop a project at any time. You pay for the work carried out up to that point. Any deposit is kept to cover that work, and any part of it not used is refunded.
C3. Consumers ordering services
A consumer may withdraw from a service contract within 14 days of accepting the quotation. If you ask us to start work during those 14 days and then withdraw, you pay for the work done up to that point. Once the service has been fully performed at your express request, the right of withdrawal no longer applies (art. 59(1)(a) Consumer Code). Physical parts made to your specifications are covered by C1.
